Why the deposit changes the duty

Stamp duty here is not a percentage of rent. It is a percentage of the total consideration for the licence, and the state treats a large interest-free deposit as part of what the landlord receives. A notional ten per cent a year on the refundable deposit is added in, which is why a flat let at ₹50,000 with a ₹3 lakh deposit attracts more duty than the same flat with a ₹50,000 deposit.

At 0.25 per cent of the total consideration for the term. Consideration is the rent for the whole period, plus any non-refundable deposit, plus a notional ten per cent a year on the refundable deposit.

A flat ₹1,000 in urban areas and ₹500 in rural areas, regardless of the rent.
Is registering a rent agreement compulsory?
Yes. Section 55 of the Maharashtra Rent Control Act requires it and places the duty on the landlord. The belief that an eleven-month agreement is exempt is mistaken.
Who pays the stamp duty, landlord or tenant?
The law places the registration obligation on the landlord, but who bears the cost is negotiable and is commonly split or paid by the tenant. Put it in the agreement either way.
